About the role

The State Solicitor’s Office is searching for dynamic and enthusiastic lawyers to join our busy Native Title and State Lands section.

The Native Title practice area deals with all matters arising under the Native Title Act 1993 (Cth). This includes representing the State of Western Australia in Federal Court native title claims and native title compensation claims involving both negotiation and litigation, as well as negotiating and drafting indigenous land use agreements and other native title agreements. The Native Title practice area also provides advice across Government on native title, Aboriginal cultural heritage and related matters.

The State Lands practice area deals with other aspects of Crown land administration, and regulatory matters relating to land including planning law and land compensation law, involving the provision of litigation and advising services across government. In litigation, lawyers may appear before the State Administrative Tribunal, for the review of decisions by State planning agencies and/or the Supreme Court, primarily in relation to other land compensation claims arising from compulsory acquisition or similar procedures. Representation is also provided for judicial review matters involving the proper administration or regulation of freehold land in Western Australia.

This recruitment process is designed to identify a body of suitable lawyers at the following levels:

Assistant State Solicitor Level L5LG  $190,176 per annum or pro rata plus super.

The decision on how many offers of employment will be made, at what levels and when, will be determined by business needs. Offers of employment which are drawn from this recruitment pool will be for an up to two year fixed term contract, with the possibility at the conclusion for permanency depending on the performance and business need.

About you

Experience with native title and state lands work, including any related or counsel experience, is highly desirable, particularly for those applying to work in the Native Title practice area. Lawyers with agreement drafting experience who are interested in native title work are encouraged to apply, as this is a growing area of our practice.

Applicants interested in the State Lands practice area should have litigation experience in the Supreme Court and/or the State Administrative Tribunal, and/or experience in property and administrative law more broadly.
